Acceptable Use Policy

1. Purpose

This Acceptable Use Policy ("AUP") defines acceptable and prohibited uses of the Max Socials platform ("the Platform"), operated by Zylver Solutions LLC. All Subscribers, their team members, and any person accessing the Platform on behalf of a Subscriber must comply with this AUP.

This AUP supplements the Terms of Service. In the event of a conflict, the Terms of Service take precedence.

2. Prohibited Content

You may not use the Platform to create, store, distribute, or publish content that:

  • Violates platform-specific community guidelines on TikTok, Meta (Facebook and Instagram), YouTube, X (formerly Twitter), LinkedIn, or Pinterest
  • Promotes violence, hatred, or discrimination against any individual or group based on race, ethnicity, religion, gender, sexual orientation, disability, or any other protected characteristic
  • Contains sexually explicit material
  • Infringes on intellectual property rights, including copyrights, trademarks, and patents
  • Constitutes spam, misleading information, or deceptive practices
  • Impersonates other brands, organizations, or individuals

3. Prohibited Activities

The following activities are strictly prohibited on the Platform:

  • Automated engagement manipulation, generating fake likes, followers, comments, or other engagement metrics through the Platform
  • Purchased engagement, purchasing followers or engagement through third-party services and connecting those accounts to the Platform
  • Unauthorized data scraping, scraping or extracting data from the Platform beyond authorized API access
  • Rate limit circumvention, exceeding rate limits or circumventing usage restrictions through technical means
  • Reverse engineering, reverse-engineering platform intelligence algorithms, scoring formulas, or proprietary systems
  • Unreviewed mass posting, using AI-generated content without human review to mass-post across accounts
  • Credential sharing, sharing account credentials with unauthorized parties outside your organization
  • Malicious use, using the Platform to distribute malware, phishing content, or any other harmful material

4. Rate Limits

Per-tier rate limits apply to all Platform functionality, including API access, content generation, and publishing. Rate limits are documented in the Platform's developer documentation and account settings.

  • Exceeding rate limits results in temporary throttling, not account suspension.
  • Persistent or intentional abuse of rate limits may result in a review of your account usage.
  • Rate limit increases are available on higher subscription tiers or by contacting our sales team.

5. Content Review

The Company reserves the right to review content flagged by automated systems or user reports:

  • Content that violates this AUP may be removed from the Platform without prior notice.
  • Subscribers will be notified when content is removed, with an explanation of the violation.
  • Repeated violations may result in account suspension as outlined in the Enforcement section below.

6. Marketplace Specific

Marketplace plugins and their developers must adhere to additional restrictions. Marketplace plugins must not:

  • Collect user data beyond the permissions stated and approved during plugin installation
  • Inject unauthorized tracking scripts, pixels, or data collection mechanisms
  • Modify platform behavior outside the scope of the plugin's stated functionality
  • Compete directly with core platform functionality in a way that undermines the Platform's offering

7. Reporting

If you become aware of any violation of this AUP, please report it to abuse@maxsocials.com. All reports are reviewed promptly and handled confidentially.

8. Enforcement

Violations of this AUP are addressed through the following graduated enforcement process:

  • First violation: Written warning with a description of the violation and required corrective action.
  • Second violation: 7-day feature restriction. Access to publishing and content generation features may be temporarily limited.
  • Third violation: Account suspension pending review. The Subscriber may appeal the suspension by contacting our support team.
  • Severe violations: Immediate account suspension without prior warning for illegal content, data theft, or activities that pose a risk to other users or the Platform's integrity.
